Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DealSense Chrome extension and the DealSense website and API service (collectively, the "Service"), operated by DealSense ("we", "us", "our").

By installing the extension or creating an account, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

DealSense is an AI-powered shopping assistant for Amazon. It provides:

• Price history charts and price-drop alerts
• AI-generated product analysis, sentiment, and buy recommendations
• Wishlist management with grouping and cloud sync
• Optional email notifications and weekly briefings

We are not affiliated with, endorsed by, or sponsored by Amazon.com, Inc. "Amazon" is a trademark of Amazon.com, Inc.

2. Account Registration

• You must provide a valid email address and a secure password.
• You are responsible for maintaining the confidentiality of your credentials.
• You must be at least 13 years old (or the minimum age in your jurisdiction).
• One account per person. Sharing accounts is not permitted.
• You are responsible for all activity that occurs under your account.

3. Free Tier and Quotas

• Free accounts receive 1,000 AI analysis calls per month, 50 per hour.
• Free accounts receive 3 verdict analyses per day.
• Free accounts are limited to 20 wishlist items.
• Free accounts can have up to 5 active price alerts. Expired or deleted alerts do not count against this limit.
• Quotas reset on the 1st of each month at 00:00 UTC.
• We reserve the right to adjust quotas with 14 days' notice.

4. Subscriptions and Payment

4.1 Merchant of Record

All payments are processed by Creem, our merchant of record. Creem is the legal seller of record for all subscriptions and handles payment processing, tax compliance, invoicing, and refunds on our behalf.

4.2 Subscription Terms

• Pro subscription costs $5.99 USD per month.
• Subscriptions automatically renew every month unless canceled.
• Your card is charged on each renewal date by Creem.

4.3 Free Trial

• New registered accounts receive a 15-day free trial of Pro features.
• No payment is required during the trial.
• The trial expires automatically — no charge occurs unless you choose to subscribe.

4.4 Cancellation

• You may cancel at any time via the Creem billing portal (accessible from your account settings).
• Cancellation takes effect at the end of the current billing period.
• You retain Pro access until the period ends.
• No partial refunds for unused time within a billing period.

We may change subscription prices with 30 days' notice. Continued subscription after the change constitutes acceptance.

5. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose.
• Reverse engineer, decompile, or extract source code from the extension.
• Abuse free-tier quotas through multiple accounts or automated means.
• Scrape, resell, or redistribute data obtained from the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Circumvent rate limits, quotas, or payment requirements.
• Impersonate others or misrepresent your affiliation.

Violation may result in immediate account suspension without refund.

6. Intellectual Property

• The Service, including source code, design, and AI prompts, is owned by DealSense.
• You receive a limited, non-exclusive, non-transferable license to use the extension for personal, non-commercial purposes.
• Product data (titles, prices, images) belongs to Amazon or respective rights holders.
• AI-generated analysis is provided for informational purposes only.

7. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

• Not financial advice. AI price predictions and buy recommendations are for informational purposes only. Actual prices may differ. Make purchasing decisions based on your own judgment.
• Not affiliated with Amazon. We do not control Amazon's pricing, availability, or policies.
• Accuracy not guaranteed. Third-party data (Keepa, Bright Data) may be delayed or inaccurate. We are not responsible for decisions made based on such data.
• Service availability. We do not guarantee uninterrupted or error-free operation.

8. Limitation of Liability

To the maximum extent permitted by law, DealSense shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or missed savings opportunities, arising from your use of the Service.

Our total aggregate liability shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $50 USD.

9. Indemnification

You agree to indemnify and hold harmless DealSense from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

10. Termination

• You may terminate by deleting your account or uninstalling the extension.
• We may suspend or terminate your access at any time for violation of these Terms.
• Upon termination, your right to use the Service ceases immediately.
• Data deletion follows the retention schedule in our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the People's Republic of China, without regard to conflict of law principles. Disputes shall be resolved in the courts of Fuzhou, China.

12. Changes to These Terms

We may modify these Terms at any time. Material changes will be notified via email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
